HomeSafe Pest & Wildlife — Terms & Conditions
Effective Date: December 24th, 2025
These Terms & Conditions (“Terms”) govern the pest control and wildlife services provided by HomeSafe Pest & Wildlife (“HomeSafe,” “we,” “us,” “our”) to the customer (“Client,” “you,” “your”). By requesting a quote, scheduling service, signing a work order, or allowing our technicians on site, you agree to these Terms.
1) Services and Scope
1.1 Services: may include inspection, trapping, exclusion, removal, treatment applications (where licensed/permitted), sanitation recommendations, and follow-up visits as described in your estimate, work order, or invoice (“Work Order”).
1.2 Treatment only: Our obligation is to provide the treatments/services described on the Work Order (this structure is standard in pest service agreements).
1.3 No guarantee of permanent results: Pest and wildlife outcomes depend on site conditions, seasonality, neighbouring activity, structural access, and animal behaviour; recurrence can occur.
2) No Money-Back Guarantee; All Sales Final
2.1 No money-back guarantee. HomeSafe does not offer refunds or a money-back guarantee.
2.2 All sales are final once service has been performed and/or products/materials have been deployed (including baits, traps, exclusion materials, labour), except where required by law (consumer rights are not waivable).
2.3 If a written warranty is offered for a specific service, it will be stated on your Work Order and will be your sole warranty.
3) Client Responsibilities and Site Conditions
3.1 Client must provide safe, timely access to the service areas and disclose known hazards (e.g., unsafe attic flooring, mould/asbestos concerns, needles/biohazards, aggressive animals).
3.2 Client agrees to follow preparation instructions and recommendations. Failure to cooperate may reduce effectiveness and may void any written warranty.
4) Pets Must Be Secured; Injuries from Unsecured Pets
4.1 Pets must be secured before technicians arrive on site. Client must contain, crate, restrain, or remove all pets/animals during the technician’s visit (this is a common, explicit clause in pest service terms).
4.2 Technician safety first. If pets are not secured, HomeSafe may pause, refuse, or reschedule service.
4.3 Liability for unsecured pets. To the fullest extent permitted by law, HomeSafe is not responsible for injuries, escapes, or damages caused by unsecured pets (including bites, scratches, knockdowns, or interference with equipment/treatments). Client remains responsible for pet control and supervision.
5) Wildlife/Pest Damage and Property Disclaimer
5.1 Wildlife/pests can cause damage. Client acknowledges pests and wildlife may cause damage to structures and contents before, during, or after service. (This “no repair/compensation” approach is standard in service agreements.)
5.2 Not responsible for damage caused by wildlife/pests. HomeSafe is not responsible for damage to property, furniture, appliances, insulation, wiring, ducting, roofing, landscaping, or personal belongings caused by wildlife/pests.
5.3 HomeSafe will take reasonable care while performing work; however, many service areas (attics/crawlspaces/roofs) involve pre-existing risks and limited visibility.
6) Scheduling, Visit Windows, and Service Routing
6.1 Service visits may be scheduled by area and availability; dates may vary to accommodate routing (many pest service providers disclose scheduling variability)
6.2 If Client requests rescheduling, fees may apply where a trip is dispatched or time reserved.
7) Pricing, Additional Work, and Changes
7.1 Estimates are based on visible conditions at time of inspection/booking. Hidden damage, additional entry points, or expanded infestation may require additional work at additional cost, subject to Client approval.
7.2 Price adjustments. Where permitted by law and disclosed in advance, pricing may change for renewals or ongoing service plans (similar “prices subject to change” clauses are common).
8) Payments, Late Fees, and Collections
8.1 Payment is due as stated on the Work Order/invoice (at booking, upon completion, or per subscription schedule, if applicable).
8.2 Late balances may be subject to administrative or finance charges and may be sent to collections; reasonable collection costs may be added (late-fee/collections language is common in service contracts).
9) Company Equipment
9.1 Any pest-control equipment left on site (traps/monitors) remains the property of HomeSafe unless sold to Client in writing (retention-of-ownership clauses are common).
9.2 Upon cancellation/completion, HomeSafe may arrange retrieval of Company equipment.
10) Limitation of Liability
10.1 To the fullest extent permitted by law, HomeSafe will not be liable for indirect, incidental, special, consequential, or punitive damages (loss of profit, loss of use, business interruption, etc.).
10.2 Liability cap. To the fullest extent permitted by law, HomeSafe’s total liability for any claim related to a particular service is limited to the amount paid for that service (this cap is commonly stated explicitly).
11) Indemnification
Client agrees to indemnify and hold harmless HomeSafe and its employees/agents from claims arising out of Client’s breach of these Terms, unsafe site conditions not disclosed to HomeSafe, or the actions of Client’s unsecured pets/animals (indemnity language is commonly used in website/service terms).
12) Communications and Electronic Notices
By providing your email/phone number and booking service, you consent to receive service-related communications electronically (email/SMS/phone), and you agree such communications satisfy any legal “in writing” requirement for notices where permitted.
13) Photos and Documentation
HomeSafe may take photos/videos for documentation, compliance, training, or quality assurance. We will avoid capturing sensitive personal information where reasonably possible. Marketing use requires separate consent.
14) Changes to These Terms
HomeSafe may update these Terms by posting a revised version on our website; changes take effect upon posting for future bookings (a common “modify upon posting” structure).
15) Governing Law
These Terms are governed by the laws of Ontario and Canada, and disputes will be brought in Ontario courts unless mandatory consumer law requires otherwise.
16) Consumer Rights (Ontario)
Nothing in these Terms limits rights or remedies that cannot be waived under applicable consumer protection law. In Ontario, certain “direct agreements” must include specific cancellation-right information, and consumers may have statutory cancellation rights in defined situations.
